Foreign Ownership & Non-Resident Acquisition in Germany

Statutory Matrix

Germany imposes no restrictions on foreign nationals (EU or non-EU) acquiring real estate. Any foreign national can purchase residential or commercial properties in fee simple. However, under the Sanctions Enforcement Act (Sanktionsdurchsetzungsgesetz II), cash purchases of real estate are strictly prohibited. Conveyancing must be conducted exclusively through a German Notar. A clearance certificate (Unbedenklichkeitsbescheinigung) from the local tax office (Finanzamt) proving payment of Real Estate Transfer Tax (Grunderwerbsteuer) is required to enter ownership into the Land Register.

    Estate Ulagam's desk checks identity and the documents above against Bürgerliches Gesetzbuch (BGB) & Gebäudeenergiegesetz (GEG) before anything moves forward.

    Correction, if needed

    Where a document is missing or unclear, the advertiser is notified and the submission stays in review — not published — until resolved.

  4. 04

    Payment and publication

    Once documents are reviewed and payment for the advertising package is confirmed, an Estate Ulagam admin approves publication.
